End-User License Agreement

About this agreement
This End-User License Agreement ("Agreement") governs your access to and use of fairmontpa.com and its online tools and services — including the event calendar, volunteer sign-ups, donation and merchandise purchasing tools, and board admin portal (together, the "Site") — operated by the Fairmont San Juan Capistrano Parent Association ("FPA," "we," "us"), an independent 501(c)(3) nonprofit organization (EIN 33-0576063) serving Fairmont SJC families. The FPA is legally and organizationally separate from Fairmont Schools and is not operated by the school. By accessing or using the Site, you agree to be bound by this Agreement. If you don't agree, please don't use the Site. This Agreement should be read alongside our Terms & Conditions and Privacy Policy.
License grant
Subject to your compliance with this Agreement, the FPA grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for its intended personal, non-commercial purpose — staying informed about FPA events and programs, volunteering, donating, and purchasing merchandise. This license doesn't transfer any ownership rights in the Site or its content to you.
Restrictions
You agree not to:
- Copy, modify, or create derivative works of the Site beyond normal browser use;
- Reverse engineer, decompile, or attempt to extract the source code of any Site tool, except where applicable law permits it;
- Use the Site for any unlawful purpose or in a way that infringes the rights of, or restricts or inhibits the use of, the Site by anyone else;
- Attempt to gain unauthorized access to the admin portal or any other restricted part of the Site.
Accounts and access
Some parts of the Site — such as the board-member admin portal — require sign-in and are restricted to an approved list of board member email addresses. You're responsible for keeping any credentials associated with your access confidential.
Third-party services
The Site relies on third-party services to operate — for example Givebutter for donation processing, our hosting provider, and (once live) a merchandise payment processor. Your use of those services is subject to their own terms and license agreements, and the FPA isn't responsible for their performance or content.
No warranty
The Site is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We try to keep information (event dates, times, and locations especially) accurate and current, but errors can happen — please confirm time-sensitive details directly with the FPA if anything seems off.
Limitation of liability
To the fullest extent permitted by law, the FPA is not liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Site.
Termination
This license is effective until terminated. We may suspend or terminate your access to the Site (in particular, admin access) at any time if you violate this Agreement. You may stop using the Site at any time.
Changes to this agreement
We may update this Agreement from time to time. Continued use of the Site after changes are posted means you accept the updated Agreement.
Governing law
This Agreement is governed by the laws of the State of California.
